Publicly available information released following an FOI access request

ACARA is required by the Freedom of Information Act 1982 s11C to publish a disclosure log on its website. The disclosure log lists information which has been released in response to an FOI access request. This requirement has applied since 1 May 2011.
 
The disclosure log requirement does not apply to:
  • personal information about any person if publication of that information would be ‘unreasonable’
  • information about the business, commercial, financial or professional affairs of any person if publication of that information would be ‘unreasonable’
  • other information covered by a determination made by the Australian Information Commissioner if publication of that information would be ‘unreasonable’, and
  • any information if it is not reasonably practicable to publish the information because of the extent of modifications that would need to be made to delete the information listed in the above dot points.
The information described in this disclosure log has been released by ACARA under the Freedom of Information Act 1982, and is available for public access.

Request covers, broadly, a large set of data from the My School website, all in electronic format. This matter was the subject of a decision by the Administrative Appeals Tribunal in Diamond and Chief Executive Officer of the Australian Curriculum, Assessment and Reporting Authority [2014] AATA 707 (29 September 2014)

In accordance with the decision of the Freedom of Information Commissioner, ACARA provided a historic, electronic list of all schools published on the My School website for the years 2008, 2009 and 2010.

·        Copies of the NAPLAN numeracy tests administered in each of the years from 2008 to 2011 (inclusive), for all of the year levels tested; and

·        Item-by-item performance data at the national level (calculated using the national calibration sample) (i.e. data disclosing for each test question the nationwide percentage of students who answered that question correctly) for 2008–2013 numeracy tests, for all of the year levels tested.

Note: only NAPLAN numeracy tests 2008–2011 (for all year levels tested) have been released under FOI. NAPLAN numeracy tests 2012–2014 have not been released. In the matter of Marty Ross and Australian Curriculum, Assessment and Reporting Authority [2015] AICmr 75 (1 December 2015), the Acting Australian Information Commissioner held that the NAPLAN numeracy tests 2012–2014 are conditionally exempt and giving access to the documents at this time would be contrary to the public interest.

NAPLAN 2008–11 tests, all year levels (3,5,7 and 9) and all domains except numeracy. The NAPLAN numeracy tests 2008–11 were previously released under FOI.

Note: 2012–15 NAPLAN tests

ACARA advises that:

·        the NAPLAN numeracy tests 2012–14 have been the subject of a decision by the Acting Information Commissioner, Timothy Pilgrim, who has decided not to release these tests under FOI– see the Marty Ross decision; and

·        It is highly likely that ACARA's FOI decision-maker would make an FOI decision not to release the NAPLAN tests 2012–14 in the other domains and the NAPLAN 2015 tests, for the same reasons as outlined in the Marty Ross decision. That is, no relevant circumstances have changed since ACARA last made a decision not to release NAPLAN papers for 2012 and beyond.
